These terms and conditions of sale are entered into by :


By Logis Escale, via SAS ESQAL, with its registered office in Gennes-Val-de-Loire, registered in the Saumur Trade and Companies Register under number 842 692 154, hereinafter referred to as "Logis Escale".
On the other hand :

Any individual or legal entity wishing to make a purchase via the website www.grandgite-escale-saumur.fr (and its other URLs), hereinafter referred to as "the customer".
The purpose of these general terms and conditions of sale is to set out the contractual provisions between Logis Escale and the customer, and the conditions applicable to any purchase made via the online booking system on the www.grandgite-escale-saumur.fr website. The acquisition of a good or a service through the present site implies unreserved acceptance by the customer of the present conditions of sale.


ARTICLE 1: PURPOSE AND SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions govern reservations made by Logis Escale for its furnished tourist accommodation within the meaning of articles L.324-1 et seq. of the French Tourism Code.
Booking a stay at Logis Escale implies the customer's full and unreserved acceptance of these general conditions of sale, which are deemed to have been read and accepted once the sales contracts have been signed.
The general conditions of sale are subject to change. It is therefore the customer's responsibility to regularly consult the general terms and conditions on the website to ensure that they have the latest version.

The full list of services included in the rental will be set out on the order confirmation.Online reservations can be made at the following address: https://www.grandgite-escale-saumur.frThe services offered are those listed in the catalogue published on the www.grandgite-escale-saumur.fr website. Each service is accompanied by an established description and its price.The information given on our media (online reservations, brochures, leaflets, etc.) is given for information purposes only and is not binding on Logis Escale, which may modify it at any time.The photographs of the accommodation and the website are for illustrative purposes only. It is possible that the product differs from what is displayed. The information provided in the photographs is not binding on Logis Escale, which may modify it at any time.
Logis Escale also reserves the right to correct any accidental material error or omission on the present conditions, as well as on any other contractual document.

ARTICLE 2 : RESERVATION PROCESS

The booking of a holiday will not be fully validated until the following steps have been completed:
Choice of dates and number of adults and childrenConfirmation of the contents of the basketIdentification or registration in order to fill in the various details requestedChoice of payment methodConfirm paymentIn the case of deferred payment (bank transfer or cheque), you have five (5) days in which to send it to us to validate your booking.
The customer will then receive confirmation of their booking. Le Logis Escale reserves the right to re-let the property if the payment deadlines are not respected. Furthermore, Le Logis Escale reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or a customer who does not have the capacity to finalise the order.

Article 3: Prices
3.1 Product description
The prices displayed on the www.grandgite-escale-saumur.fr website include VAT and are in euros (€). The description of the service indicates what is included in the price and what is not. Prices may change during the season.
Logis Escale reserves the right to modify its prices at any time, it being understood that the price shown on the website on the day of booking will be the only price applicable to the customer. No refund or credit note will be issued in the event of the customer waiving certain services indicated on the booking form.
3.2 Terms of payment
- More than 30 days before the date of the holiday, payment of a deposit of 30% of the total price at the time of booking.
- Less than 30 days before the date of your stay, payment of the total amount of your stay or the outstanding balance.

3.3. Failure to pay the balance
Any non-payment of the balance within 15 days on the part of the purchaser, whether total or partial, will lead to the suspension of the reservation, with the resulting costs being borne by the Client, without prejudice to any action that may be taken against him/her. As a result, Logis Escale will not be obliged to maintain the availability of the accommodation.

3.4. Means of payment
You may pay by credit card (secure), bank transfer, cheque, holiday vouchers or cash within the limits authorised by law. Payments by holiday vouchers are limited to 50% of the order amount.


ARTICLE 4: ADMINISTRATIVE AND HEALTH FORMALITIES

It is the traveller's responsibility to find out about the health formalities in force at the time of booking, to comply with them and, if necessary, to bear the costs. Before booking our accommodation, you must check that you are in possession of a valid passport or other document that complies with the requirements for transiting and/or entering France.

Non-EU nationals must obtain information on the administrative formalities (visas, etc.) and health formalities (vaccinations, etc.) required in France from the relevant embassies and consulates before booking/entering.

The consequences of non-compliance with administrative and health formalities by the traveller, such as the impossibility of taking departure on the date indicated, are the sole responsibility of the latter. SAS ESQAL may not, under any circumstances, be held responsible for the consequences of failure by the hirer or a member of his/her group to comply with police, customs or health regulations prior to or during the journey (e.g. loss of identity papers and/or train tickets, etc.).


ARTICLE 5: ASSIGNMENT, MODIFICATION OR CANCELLATION OF THE CONTRACT

The purchaser is informed that, in application of article L. 121-20-4 of the Consumer Code, all of the Services offered on the www.grandgite-escale-saumur.fr Website by Logis Escale are not subject to the application of the right of withdrawal provided for in articles L. 121-20 et seq. of the Consumer Code with regard to distance selling. Consequently, the Services ordered on the Site are exclusively subject to the cancellation and modification conditions set out herein.

5.1. Modification or cancellation by the customer
Any request for cancellation or modification must be sent by e-mail. The date on which the request is received will be the date on which the costs are calculated. In the event of cancellation, you must inform the insurance company by letter with acknowledgement of receipt. The insurance company will assess the date and circumstances of your cancellation on the basis of the documents you provide directly, before agreeing to reimburse you for the cancellation costs.
Before the holiday. Any request for modification of one or other of the rental services, after validation, will be invoiced at 5% of the rental price (with a minimum of 50€/file) insofar as Logis Escale is able to satisfy this request.

Any cancellation or modification by the customer will incur the following cancellation charges.

For all bookings cancelled :
- more than 30 days before the date of stay: 10% of the total price.
- between 30 and 15 days before the date of your stay = 50% of the total price.
- from 14 to 7 days before the date of your stay = 75% of the total price.
- less than 7 days before departure = 100% of the total price.

If the gîte is re-let for the same period, no cancellation fee will be charged. However, a flat-rate re-letting fee of €150 will be deducted from the refund of your deposit.

If you find yourself unable to take part in the trip (because you are unable to produce the necessary documents, such as a passport, visa, vaccination certificate, or for any other reason), the trip will not be refunded under any circumstances and the above cancellation fees will be payable to Logis Escale.

5.2. Partial cancellation of a reservation and assignment of the contract
If one or more participants initially included in the contract cancel(s) prior to departure, any resulting additional costs will be borne by the other members.

5.3. Changes made by Logis Escale
If, prior to arrival, Logis Escale finds itself obliged to make a significant change to the rental conditions / services included in the contract, Logis Escale will notify you by any means enabling you to obtain an acknowledgement of receipt, as quickly as possible.
You may :
- Either cancel the contract and obtain a full refund of the sums paid;
- Accept the change proposed by Logis Escale. In the event of a price reduction, the overpayment will be refunded before the date of arrival.
The customer must inform Logis Escale of his/her decision (acceptance of the modification or cancellation) within a maximum of 3 days from receipt of the aforementioned information. If no response is received within this period, the customer will be deemed to have accepted the proposed change.
If Logis Escale decides to cancel the rental before the start of the rental period, Logis Escale will inform you by any means that allows you to obtain an acknowledgement of receipt. If the parties are unable to reach an amicable agreement on a replacement rental period, Logis Escale will reimburse the customer for the full amount paid. 

ARTICLE 6: LIABILITY

Logis Escale may not under any circumstances be held responsible for circumstances falling under force majeure or the poor execution of the contract, for which the customer would be responsible. Logis Escale cannot be held responsible for the execution of services purchased on site by the customer and not included in the description, nor for transport to and from the departure and arrival points of the tour. Logis Escale cannot be held responsible for delays or changes to the carrier's timetable or itinerary that the customer decides to use before, after or during the stay. In such circumstances, any delays incurred will not give rise to any compensation payable by Logis Escale.

ARTICLE 7: INSURANCE

Logis Escale recommends that its customers take out an insurance policy covering health risks. Two insurance companies appear to us to be competent in this field. The general and special conditions of these insurances can be consulted on their websites www.campez-couvert.com and www.jassuremeslocations.com. The cost of this insurance is borne entirely by the customer.

ARTICLE 8: MATERIAL DAMAGE

The customer is entirely responsible for the condition of the accommodation at the end of the rental period. He/she accepts responsibility for any repairs that may be required as a result of any damage that he/she may have caused. It will therefore be up to the customer to provide proof that the state in which the accommodation and/or its equipment is returned is the same as that in which it left or that the damage caused was not their fault. In the same way, the customer agrees to bear all costs associated with the loss or theft of the rented equipment.

ARTICLE 10: RETRACTIONS AND COMPLAINTS

10.1. Right of withdrawal
In accordance with article L.121-20-4 of the French Consumer Code, the customer does not have a right of withdrawal once the booking contract has been accepted when the booking is made online at www.grandgite-escale-saumur.fr or signed and returned by post/email.

10.2. Complaints
Any failure in the performance of the contract must be noted on site, reported and justified as soon as possible, in writing, by the customer. The complaint may not be subjective, but must relate exclusively to the contractual elements of the holiday.
All complaints must be sent by any means that allows an acknowledgement of receipt to be obtained within one month of the date of return, to the following address: SAS ESQAL, 11 La Croix de Joreau, Gennes 49350 Gennes-Val-de-Loire. The response time is 4 weeks.

ARTICLE 11: PERSONAL DATA

SAS ESQAL collects personal data as part of the registration process, in compliance with the French Data Protection Act of 6 January 1978.
The collection of this data enables SAS ESQAL to manage customer requests and to ensure the execution of contracts entered into. SAS ESQAL will not pass on this data to its partner service providers without specific authorisation.
Customers have the right to access, modify, rectify and delete their personal data (art. 38 et seq. of the amended Law of 8.01.1978) that SAS ESQAL has collected.
